1. General provisions – Scope of application:
FRANTOIO OLEARIO SANTINELLI FRANCESCO & C. (VAT number: 01273110567, hereinafter also “the Frantoio”), with registered office in Caprarola Via San liborio 25, informs the Customer that the relationships between the Parties (i.e. the Frantoio and the Customer) relating to the sale of products (hereinafter also “the Products”) displayed on the website www.frantoiosantinelli.com . (hereinafter also “the Site”) are governed by the terms and conditions set out below.
Therefore, these General Conditions of Sale constitute an integral part of each offer, purchase order, order confirmation or any other transaction of the Products on the Site.
The updated version of the General Conditions is also available on the Website.
The Customer is exclusively the Consumer referred to in art. 3, letter a), Legislative Decree 6 September 2005, n. 206 (Consumer Code) and therefore the natural person who acts on the Site for purposes outside of his or her entrepreneurial, commercial, artisanal or professional activity, if any.
For other buyers not included in this category of consumers, the provisions of the Civil Code and current legislation will apply.
2. The Products – Information relating to them:
The Customer acknowledges and is informed that he can find information relating to the essential characteristics of the Products, including the relative prices, on the Site within each Product sheet.
3. Product Order and Acceptance:
The purchase of the Products occurs only through an order by the Customer placed via the Site (hereinafter also “the Order”). In particular, the Customer undertakes to fill out the electronic order form on the Site in its entirety, indicating among other things the elements necessary to identify himself, the Products ordered and the quantity, the place of delivery and the payment methods, and undertakes to provide accurate and truthful data, assuming the relative responsibility.
The Customer acknowledges that he/she must send the Order filled out by him/herself to the Frantoio, electronically, following the relevant instructions present from time to time on the Site. Before proceeding with the purchase of the Products and therefore before sending the Order, the Customer undertakes to carefully read these General Conditions, displayed during the Order registration procedure, which he/she expressly declares to have understood and accepted by marking the appropriate space on the Site. More specifically, the Customer undertakes to view the information on the essential characteristics of each Product ordered, their prices and payment methods, the delivery costs of the Products, the methods of the right of withdrawal and the times for returning the Products contained in this document and in the documents present on the site and relating to the specific characteristics of the individual Products.
The Customer acknowledges that, once the online purchase procedure described above has been completed, he/she must verify the accuracy of the data indicated by him/her and correct any input errors, print and store the Order and the attached General Conditions or in any case memorize or reproduce a copy. The Order will be archived by Frantoio in the database of the Site for the time necessary for its processing.
The Customer may access the Order placed by the same by consulting the "My Orders" section of the Site. Confirmation of receipt of the Order is sent by Frantoio to the Customer at the email address indicated by the latter during the Order placement phase. With this communication Frantoio summarises the Order data, the General Conditions of Sale, the essential characteristics of the Product ordered, the price and payment made, the methods and costs of delivery, the methods for contacting it and recalls the conditions for the exercise by the Customer of the right of withdrawal. This communication is equivalent to acceptance by Frantoio of the contractual proposal formulated by the Customer by means of the Order filled out by the same and sent via the Site: in this way the contract between the Parties is perfected. Frantoio undertakes to promptly communicate by email to the Customer any out of stock of the Products and to reimburse any price already paid by the Customer.
By placing an Order, the Customer confirms that he or she knows and accepts the General Conditions of Sale and the additional information contained on the Site, also referred to via links, including the “How to place an order” procedure, the “Privacy Policy” and the “Returns and Refunds” information. Once the first purchase has been made on the Site as described above, the Customer may, at his or her discretion, use the “Quick Purchase” method which will allow him or her to safely save his or her delivery address for the Products to speed up future purchases, as specified from time to time in an updated manner on the Site during the Order placement procedure.
4. Product Prices - Terms and Methods of Payment:
The prices displayed on the Site for each Product are expressed in Euros, are inclusive of VAT and are valid at the time the Order is sent by the Customer.
The shipping costs described in the following article 5 are added to the total amount of the Order.
In the event of delivery of the Products to a country other than Italy, the Customer will also be responsible for any costs due to any taxes, duties or charges provided for by the legislation in force in the country of destination.
The tax documentation will be issued at the time of shipment of the Products to the Customer.
Payment methods for the Products displayed on the website www.frantoiosantinelli.com are as follows:

Payment by credit card is made through the Nexi service with the guarantee of maximum security.
Payment data is protected by using the most advanced technological and coding systems (SSL). This refers, in particular, to VeriSign certificates that ensure the highest protection in the field of electronic commerce.
Payments on the site are further guaranteed by the use of the Verified by Visa and MasterCard Secure Code systems. Verified by Visa and MasterCard Secure Code ensure that both the customer and the retailer from whom the purchase is made are actually the owners and authorized to make the payment, through the typing of an additional password that significantly increases the level of security of the purchases made.
Il Frantoio undertakes to deliver the Products selected and ordered by the Customer to the address indicated in the Order by means of a trusted express courier in Italy and in other countries of the European Union, provided that the information has been provided by the Customer in an accurate and truthful manner with all the data necessary for the correct fulfillment of the delivery.
The Products will be delivered in Italy from Monday to Friday, excluding public holidays, from 9.00 to 18.00 approximately within 4/5 working days from acceptance of the Order by the Frantoio. The cases of force majeure, unforeseeable circumstances or in any case causes not attributable to the Frantoio remain valid. It is understood that deliveries of the Products relating to Orders accepted by the Frantoio on Thursday after 12.00 and on Friday will be taken over by the courier on the following Monday in order to preserve the integrity of the Products and avoid their storage in the courier's warehouses. If no one is present at the first access by the courier, the courier will make a second and third access in the following days before returning the Products to the Frantoio due to the absence of the recipient Customer.
Given the perishability of some products that can be purchased, it is very important that the address indicated by the customer is an address (whether home or office) where there is someone to receive the package.
The times and methods of shipping the Products to other European Union countries other than Italy differ from country to country and are detailed on the Site on the “Shipping times and costs” page. This document, which the Customer undertakes to read carefully, also contains further specifications regarding the deliveries of the Products in the Italian territory.
Upon delivery of the Products by the courier to the address described above, the Customer undertakes to verify the integrity of the package delivered to him and the correspondence of the number of packages with respect to that indicated in the transport document.
The Customer is aware that if the package is altered or if the box or tape does not bear the name “Frantoio Santinelli”, the Customer must refuse delivery with the express indication of “Tampered package”. The Customer is aware that any damage to the package or to the Products or the lack of correspondence in the number of packages must be immediately contested by means of a specific “control reservation” written on the courier’s proof of delivery, under penalty of forfeiture of the right to raise subsequent disputes regarding the congruity, integrity and completeness of the delivered package. At any time, the Customer may check the delivery times of his/her Order and the status of the shipment by connecting to the site of the courier chosen by Frantoio and indicated by the same in the Order acceptance email by entering the shipment number indicated by Frantoio in that email.
The delivery costs of the Products are borne by the Customer, unless otherwise expressly indicated from time to time on the Site for promotional purposes, and are clearly reported on the Site on the Shipping times and costs page, the information of which forms an integral and substantial part of these General Conditions, as well as in the Order form.
6. Replacement of Products:
The Customer has the right to request the replacement of the Products, in the event of any damage during transport, if he has made the control reservation indicated in the previous article 5. This right must be exercised by the Customer, under penalty of forfeiture, within and no later than five (5) working days from receipt of the Product by sending an email to Frantoio at info@frantoiosantinelli.com. Frantoio undertakes to send the replacement Products to the Customer by means of its own trusted courier without charging additional shipping costs within a reasonable time from the request.
7. Right of withdrawal - Return of Products - Refund methods:
The Customer has the right to withdraw from the Contract in question, without any penalty and without specifying the reason, within 15 working days from the day of receipt of the Products. The Customer who has purchased in Italy may therefore return, at his own expense, the Products purchased within fifteen (15) days of their delivery, provided that they have not been even partially used, and the Frantoio undertakes to reimburse the sums already paid by the Customer as soon as possible and in any case within fifteen (15) days from the date on which the same became aware of the exercise of the right of withdrawal by the Customer.
The Customer must return the Products to the Frantoio intact and unused, not even partially, in their original packaging, and in the external package carefully opened and then resealed or in a new package created by the same, suitable for transport, closed and not accessible, handing them over to the courier within fifteen (15) working days of their receipt.
Return postage costs are the sole responsibility of the Customer.
The Customer undertakes to deliver the package, properly prepared, to the courier and to communicate to Frantoio the withdrawal by sending an email to info@frantoiosantinelli.com within the same period of 15 working days. If the delivery of the Products has taken place outside of Italy, the costs necessary for the return of the purchased Products remain the responsibility of the Customer. If the withdrawal is exercised by the Customer according to the terms and methods described above, Frantoio undertakes to refund, on the credit card used for payment or through Paypal, the sums already paid by the same Customer as quickly as possible and in any case within the maximum term of fifteen (15) days from the date on which it became aware of the exercise of the right of withdrawal.
If the terms and conditions for exercising the right of withdrawal are not respected, the Customer will not be entitled to a refund of the sums already paid. The Frantoio will contact the Customer by email if his return cannot be accepted because it does not comply with the conditions set out herein. The Customer acknowledges and is aware that he will not be able to exercise the right of withdrawal, due to the lack of the essential condition of integrity of the Product (packaging or its contents), in cases where the original packaging containing the purchased Product is missing or damaged or essential elements of the Product are missing. The Customer acknowledges that the right of withdrawal cannot be exercised for highly perishable Products, which due to their consistency and nature risk altering or deteriorating rapidly.
8. Customer Obligations:The Customer, aware of the criminal liability for false declarations, declares to be a Consumer as described in the epigraph and as provided for by the legislation in force, to be of age and that the data provided by the same for the execution of these General Conditions are correct and truthful.
9. Processing of personal data - Privacy:
The Customer is informed and has read the information on the processing of personal data by clicking the following link Privacy Policy. The Customer acknowledges that the information contained in the document referred to above forms an integral and substantial part of these General Conditions and is therefore considered to be fully known and accepted by the same at the time of transmission of the Order.
10. Partial nullity:
The possible invalidity of one or more individual clauses of these General Conditions does not imply the invalidity of the General Conditions themselves or of the entire Sales Contract, but rather the replacement of such invalid clauses with mandatory provisions.
11. Applicable law - Competent court:These General Conditions and in any case every purchase made by the Customer on the Site is governed by Italian law. For any dispute relating to the application, execution, interpretation and violation of these General Conditions, the Court of residence or elected domicile of the Customer shall have exclusive jurisdiction if located in the territory of the Italian State. If the residence or domicile of the Customer is not located in the territory of the Italian State, the Court of Viterbo shall have jurisdiction.
The Customer has the right to contact a body for the resolution or mediation of disputes that may arise in relation to these General Conditions and to any purchase or transaction carried out on the Site in order to seek an alternative resolution of the same disputes. For further information on this tool, the Customer may contact the Frantoio according to the methods indicated in the following article 12.

The Customer also declares to have read, carefully read, understood and specifically approve, pursuant to and for the purposes of art. 1341 of the Civil Code and Legislative Decree no. 206 of 6 September 2005, the following clauses of these General Conditions, the title of which is given for illustrative purposes only, and that by accepting these general conditions, the Customer also expressly accepts all of the following clauses: 1.
